Because of our individual vigilance and cooperation as well as the association’s enforcement of the PARKING rules at Trilogy, our community has so far been spared the devaluating and unsightly “red stripes-no parking” lines that so many communities are faced with.

 

While most homeowners abide by the rules that are enforced for safety and convenience, (emergency vehicle access and guest parking availability), there are a few residents who fail to abide by the obligations they agreed to live by when they purchased their home in our exclusive community. 

 

Surveillance and towing of illegally parked vehicles will be increased to protect our community.

Vehicles continue to park in FIRE ZONES, and guests find it difficult to find available parking within a reasonable distance of their host’s home.  Some residents continue to use guest parking in lieu of their garages, and some guests are using guest parking for longer than the 3 days within a 30-day period without a temporary permit. 

 

To prevent your vehicle from being towed you must abide by the PARKING RULES.  Here they are:

 

The parking policy is clearly stated in Article VI of the Declaration of Restrictions for Trilogy.  In summary, the restrictions indicate that all of the streets and drives in the complex are private and considered a FIRE LANE unless marked otherwise

 

1.          In no event shall parking be permitted along any private street or drive designated as a Fire Lane. (Remember, almost everything is a FIRE LANE unless marked otherwise) 

 

2.          Parking spaces shall be reserved exclusively for guest parking, or for a resident vehicle displaying a CURRENT and valid quarterly permit.  (NO cobblestone parking for vehicles with permits; violation of this parking regulation will result in immediate towing of the vehicle with costs levied against the vehicle owner.)

 

3.          Guest parking longer than 3 days within a 30-day period is not allowed.  Temporary Guest Parking permits are available by calling N.N.J at 858-550-7900. 

 

4.          No owner shall have any right to park any vehicle in the Association Property parking areas with the exception of those Residential Units with one car garages and for which the condominium plan shows as including an appurtenance outside parking exclusive use area.

 

5.          The City of San Diego has made parking available on the south side of Carmel Creek Road adjacent to our community.  Long-term guests and residents with extra vehicles may park there without Trilogy permits.  Be sure to turn your wheels out from the curb when facing uphill!

 

6.          Improper parking on homeowner's “Exclusive Use Common Area" property (driveways) is against the rules.

 

7.          Failure to maintain your garage for fully designed vehicle storage (using ALL garage space to park vehicles) constitutes a violation and will result in the revocation of any permits and/or subject your vehicle(s) to being towed.

 

8.     In the event a homeowner has more vehicles than may be placed within homeowner's garage and/or more drivers than the homeowner residing in homeowner’s residence, the homeowner (only) of said residence may submit an application requesting that homeowner be awarded a Quarterly Parking Permit to park an additional vehicle in a "Black Top Guest Parking Space" in the common area.  This permit may be issued by the Board for a qualified vehicle that is registered to an additional driver so long as that driver has a valid driver's license, shows proof of automobile insurance, and is permanently residing in the applicant’s residence.  There are only a limited number of permits that may be issued at any one time, and they are reviewed (and renewed) quarterly.  At the end of each quarter, if there are more applicants than spaces available, all applicants regardless of receipt of a prior permit shall enter a lottery, and new permits (if any) will be issued as a result of a blind draw.  No applicant will be considered for a permit should the homeowner not be in full compliance with all governing documents and current on payment of assessment fees and/or fines at the time of application. As a condition of award, homeowner shall execute an agreement indemnifying and holding Association harmless from any and all claims of damage or loss arising from usage of the common area parking space.  The Association requires that homeowner present proof of insurance indicating that homeowner’s insurance policy shall be the primary insurer with respect to any such claim and that Owner shall be responsible for the deductible (if any) for such policy, personally.  Application forms are available from the management office or the Trilogy web site www.trilogy123.com (Parking).  The cost of a Quarterly Parking Permit is $50.  Quarters are defined as: (January, February, March), (April, May, June), (July, August, September), and (October, November, December).

 

9.     A Temporary Guest permit is available at any time for a homeowner who will have a short-term guest visiting.  Short term is defined as greater than 3 days but not more than 10 days.  A Temporary Guest permit will be considered for longer than 10 days but not for more than 30 days.  Extension of a Temporary Guest permit shall be at the discretion of the Association based on special circumstances.  Guest vehicle information must be provided to the management company.  The temporary permit will be issued upon your guest’s application being received.  A homeowner is entitled to no more than one Temporary Guest permit in a 90-day period. WHEN YOU ARE SUBJECT TO HAVING YOUR VEHICLE TOWED

 

 

We tow any vehicle parked on an asphalt or cobblestone surface that is parked in a designated Fire Lane. A Fire Lane is every area that is not marked by green or white parking lines or clearly marked “Guest Parking”.   Any Quarterly Permitted resident vehicle parked on any cobblestone surface will be towed.

 

If your car has been towed you can call the Management Company, N. N. Jaeschke, at (858) 550-7900 to inquire as to where your vehicle has been taken.  Towing and storage fees are the responsibility of the vehicle owner.  Any property damage, including but not limited to water line breaks by the tow truck operator in performing his/her job of towing a vehicle, will be the financial responsibility of the homeowner and/or vehicle owner.  (A "drop fee" charge of  $50 will be imposed on the homeowner once a tow truck has been dispatched in the event the vehicle is moved before the tow truck arrives). 

Improper parking on homeowner's driveways is both an inconvenience to neighbors as well as a violation of the governing documents.  In most cases, driveways do not belong to homeowners.  They are Common Area property that has been provided to the homeowner for their exclusive use.  Driveways are subject to the same Rules as other Common Area property.  We need to adhere to the proper use of the driveways.  Included below is a list of property addresses that indicate how many vehicles you may park in your driveway and on WHAT SIDE THEY MUST BE PARKED.  A homeowner and/or resident will be sent a letter of notification for the first two offenses.   If the situation occurs a third time, the homeowner will receive legal notification from the Association's attorney, which incurs a charge of approximately $150.00. 

Vehicles must be parked in your garage or designated spot.  Garages are not to be used for storage, EXCEPT you may store what you wish in the garage as long as it will still accommodate two cars (one car if a single car garage).  Homeowners and/or renters may not use Guest Parking, except for vehicles displaying a valid “third vehicle permit” (see below); violators are subject to towing.  A guest vehicle observed using any Guest Parking for more than any 3 days within a 30-day period is considered in violation and is subject to being towed, UNLESS a valid Guest Parking Permit is displayed. Call NNJ at (858) 550-7900 to apply for a third vehicle or guest Parking Permit.  

 

If you have a third vehicle in your household, for the use of three (3) licensed operators who are full time residents in your household, you need to register ALL your vehicles with the Management Company at (858) 550-7900 and request a Quarterly Parking Permit for a third vehicle to park that vehicle within Trilogy property (see item 8 in the previous section).  The cost for a Quarterly Parking Permit is $50 per quarter.  A Quarterly Parking Permit is revocable for failure to comply with any of the CC&R’s, Rules, or the Parking Rules & Regulations.  Failure to display a proper Permit will result in the vehicle being towed at your expense. 

 

 

 

This letter serves as notification of the TOWING POLICY, which became effective July 1, 2001.

Storage of vehicles on Trilogy property is not permitted. 

 

Please include a copy of the DMV registrations for all three (3) vehicles, a copy of the valid driver's license for all three drivers, and proof of insurance for all vehicles.  An inspection of your garage with all vehicles present is required before approval will be granted.  Homeowner’s HOA assessment accounts must be current of all assessments, fines, water bills and fee’s before a permit can be obtained!

THIS PERMIT IS ISSUED SPECIFICALLY TO THE 3RD LISTED VEHICLE & MAY NOT BE TRANSFERRED TO ANY OTHER VEHICLE.  IF FOUND ON A VEHICLE OTHER THAN THE PERMITTED VEHICLE, THE OFFENDING VEHICLE WILL BE TOWED WITHOUT NOTICE.

 

 

$50 Permit fee is to be submitted with this Application.
